Jason Domark and Paul Ferland presented a webinar for the Association of Corporate Counsel titled, "Taking Attorney - Client Privilege In-House: Rules, Tests and Tips to Protect the Privilege."
This presentation focused on understanding the application of the attorney-client privilege in relation to in-house counsel. The presenters discussed how the tests courts have set forth to determine when and how the privilege applies and does not apply, in various contexts, including general corporate business activities, accounting, insurance, etc. In addition, the presenters provided practical tips in-house counsel can use when intending to keep communications privileged.
